醫務紛爭涉及高度專業性、當事人關係及多元利益，於傳統訴訟之外，仲裁、調解等多元紛爭解決機制是否能提供更適切的處理途徑，值得深入探討。本研討會將從仲裁及ADR制度出發，結合醫務紛爭的類型與實務案例，探討醫療爭議在專業判斷、責任認定及紛爭處理上的特殊性，並進一步分析仲裁及調解等機制之適用可能與實務挑戰。邀集醫療、法律及學術界專家交流，共同探索仲裁與ADR在醫務紛爭解決中的可能性，為醫療爭議提供兼具專業性與程序彈性的解決途徑。

Medical disputes often involve high levels of professional expertise, complex party relationships, and diverse interests. Beyond traditional litigation, mechanisms such as arbitration and mediation may offer more appropriate avenues for resolution, warranting further exploration. This symposium will examine the unique aspects of medical disputes, including professional judgment, liability determination, and dispute resolution, by analyzing the arbitration and ADR systems in conjunction with various types of medical disputes and practical case studies. We invite experts from the medical, legal, and academic fields to engage in discussions and jointly explore the potential and practical challenges of applying arbitration and mediation in resolving medical disputes.
